今回の条例が採用しているのは、「有害な表現は人間を有害な行為に導く」という命題である。
けれども、この命題はトートロジーであり、論理的には何も言っていないのと同じである。
「有害な表現」という主語はそれが「有害な行為」の主因であるということが論証されない限り、「有害」という形容詞を引き受けることができない。
たしかに「有害な行為」というものは事実として存在する。
性犯罪や殺人はとりあえず被害者にとっては間違いなく「有害」である。
けれども、「まちがいなく有害な表現」というものはこの世には存在しない。
それは、その図書なり図画に触れたことが「有害な行為」の一因であったということが証明されたあとに、遡及的にはじめてその有害性を認知される「仮説」としてしか存在しない。
そして、この仮説はかつて証明されたことがない。
